劳教制度虽然已经废除, 但是中国现行法律体系中还存在着一些与劳教制度相似的剥夺人身自由的行政羁押措施. 这些措施, 与劳教制度一样, 都是由公安机关决定较长时间限制和剥夺公民人身自由, 与《公民权利和政治权利国际公约》所规定的应当由法院控制羁押措施的要求不一致, 因此成为需要加以关注并解决的问题.
