Bank guarantees in various forms have become widely used as an efficacious means of providing protection against counterparty risk in numerous business transactions. The monograph presents a comprehensive study of a wide range of these undertakings from a practical, financial, and commercial point of view but with a clear focus on the legal aspects of bank guarantees of the utmost importance for their use and efficiency. It is based on a theory and practical experience, a comparative study of several national laws and regulations, autonomous international business law incorporated in various rules and practices published by the International Chamber of Commerce, the United Nations Convention on Independent Guarantees and Standby Letters of Credit, and legal texts, along with systematic survey of case law in different civil law and common law jurisdictions.
