O presente trabalho tem a finalidade de analisar, na definição da alíquota do ICMS sobre energia elétrica, a obrigatoriedade da aplicação do princípio da seletividade, previsto no art. 155, § 2º, III, da Constituição Federal. A seletividade decorre do princípio da capacidade contributiva, e é efetivada com a fixação de alíquotas menores para mercadorias e serviços essenciais. Considerando que atualmente a energia elétrica é um serviço essencial para toda a sociedade, é possível afirmar que ela merece ser tributada de forma mais branda. Dessa forma, foi feita uma análise da legislação sobre a matéria, à luz da doutrina e jurisprudência, o que evidenciou a existência de grande controvérsia sobre o tema.
